U.S. Consumer Health Data Privacy Notice

Attends Healthcare Products, Inc. (a part of Attindas Hygiene Partners) and its affiliates and subsidiaries (“Attindas,” “we,” “us,” or “our”) respects your privacy. This Consumer Health Data Privacy Notice (“Notice”) explains how we collect, use, disclose, and protect personal data defined as “Consumer Health Data” subject to the Washington My Health My Data Act, Nevada Health Data Privacy Act, and other applicable state consumer health privacy laws (“Consumer Health Privacy Laws”). As used in this Notice and defined by Consumer Health Privacy Laws, “Consumer Health Data” means personal information that is linked or can be reasonably linked to a consumer and that identifies the consumer’s past, present or future physical or mental health status. Consumer Health Data does not include information pertaining to individuals with whom we have an employment relationship.

If we make any material updates to this Notice, we will notify you as required by Consumer Health Privacy Laws. We reserve the right to amend this Notice at our discretion and at any time.

Categories of Consumer Health Data We Collect

We collect the following categories of Consumer Health Data:

  • Information about your health-related conditions, symptoms, side effects, or status, for example, incontinence, menstruation, or postpartum status; and
  • Information about your interest in certain health-related products, including product selections, product usage frequency, and size requirements
  • Health concerns shared in any communications with us
  • Inferred health information based on your browsing behavior, such as visiting pages that are specific to certain health needs

Sources of Consumer Health Data

We collect Consumer Health Data from the following sources:

  • Directly from you, such as when you purchase products on your behalf or on behalf of someone you are caring for (e.g. a family member)
  • From your interactions with us, such as when you browse our websites
  • From our business and marketing partners who provide us with information about individuals who are viewing our website content
  • From other third-party sources such as retailers and pharmacies who provide us with information about individuals that may be interested in our products
  • We may also infer or derive Consume Health Data by analyzing other non-health related data we have about you

Purposes of Collection and How We Use It

We collect and use your Consumer Health Data for the following purposes:

  • Performing services for you and sending you certain products you have requested
  • Administering and maintaining accounts and preferences
  • Responding to your questions or requests for information
  • Sending transactional messages (such as order confirmations).
  • Sending marketing communications about our products (or the products or services of our partners), surveys, and invitations.
  • Processing your payment for the products you purchase from us.
  • Serving you with relevant ads and measuring and tracking the effectiveness of advertising campaigns and carrying out other administrative and accounting activities with respect to advertising campaigns.
  • System administration and technology management, including optimizing our websites
  • Detecting threats and protecting against malicious or fraudulent activity
  • Risk management, audit, investigations, reporting and other legal and compliance reasons
  • Internal research, including designing and developing new products, services, and programs.

Disclosure of Consumer Health Data

We do not sell Consumer Health Data, but we may disclose the above categories of Consumer Health Data above with our service providers who help operate our websites and fulfill requests (e.g. website hosting providers and shipping vendors). We also may disclose Consumer Health Data with our U.S. affiliates and subsidiaries, where permitted by law, and with marketing partners or analytics providers, only with your opt-in consent.

We also disclose Consumer Health Data as permitted by law, such as (i) with your consent, (ii) if needed to protect your vital interests, such as in the event of a medical emergency, (iii) to an acquiring organization if we are involved in a sale or a transfer of our business, (iv) as needed to prevent, detect, protect against, or respond to security incidents, identity theft, fraud, harassment, malicious or deceptive activities, (v) as needed to preserve the integrity or security of our systems, or (iv) to investigate, report, or prosecute those responsible for any action that is illegal under applicable law.

Exercising Your Privacy Rights

If you are covered by applicable Consumer Health Privacy Laws, you may have certain rights with respect to your Consumer Health Data, including:

  • The right to know if we are collecting, using or disclosing your Consumer Health Data, to access that Consumer Health Data, including receiving a list of the third parties with whom we have shared or sold your Consumer Health Data.
  • The right to request that we delete your Consumer Health Data.
  • If we are processing your Consumer Health Data with your consent, you have the right to withdraw that consent.

Please allow up to 45 days for a response. If we deny your request and you wish to make an appeal, please send us an email to dpc@dataprivacy@attindas.com. If your appeal is unsuccessful, you may lodge a complaint with the Washington State Attorney General at www.atg.wa.gov/file-complaint, the Nevada State Attorney General at https://ag.nv.gov/complaints/file_complaint/, or other regulatory authority as applicable.
